Farkl\u0131 konu ba\u015fl\u0131klar\u0131nda perakende sekt\u00f6r\u00fcne etkisi olan konularla ilgili fark\u0131ndal\u0131k sa\u011flamaya y\u00f6nelik pek \u00e7ok \u00e7al\u0131\u015fma ger\u00e7ekle\u015ftiren TAMPF, bu \u00e7er\u00e7evede de \u201cTAMPF Dijital Arac\u0131l\u0131k Hizmetlerine \u0130li\u015fkin Kamusal D\u00fczenlemeler&#8221; Raporunu yay\u0131nlad\u0131.<\/p><p>Dijital devrimin bir \u00fcr\u00fcn\u00fc olarak ortaya \u00e7\u0131kan ve ekonomik parametreleri tek ba\u015f\u0131na belirleyebilme g\u00fc\u00e7leri giderek artan dijital platformlar\u0131n hizmetlerinin d\u00fczenlenmesine i\u015faret edilen Raporun iki temel hedefi g\u00f6ze \u00e7arp\u0131yor: Ba\u015fat platformlar\u0131n rekabeti ortadan kald\u0131racak uygulamalar\u0131n\u0131n kontrol alt\u0131na al\u0131nmas\u0131 ve kendi lehlerine, \u00e7o\u011fu ekonominin lokomotifi olan KOB\u0130 niteli\u011findeki kurumsal kullan\u0131c\u0131lar\u0131n aleyhine ticari ko\u015fullar dayatmas\u0131 ihtimalinin \u00f6n\u00fcne ge\u00e7ilmesi.<\/p><p>Bu kapsamda 3 temel yakla\u015f\u0131m sunulan raporda, en do\u011fru yakla\u015f\u0131m olarak Cremer Raporu\u2019nda \u00f6rneklenen hibrit uygulama esas al\u0131n\u0131yor. Hem rekabetin tesisi hem de haks\u0131z ve adaletsiz ticari ko\u015ful dayatma davran\u0131\u015flar\u0131n\u0131n ex-ante ve ex-post d\u00fczenleme mekanizmalar\u0131n\u0131n birlikte kullan\u0131m\u0131 ile kontrol al\u0131nmas\u0131n\u0131 \u00f6ng\u00f6ren bu yakla\u015f\u0131m, Avrupa Birli\u011fi taraf\u0131ndan da benimsenmi\u015f durumda.<\/p><p>TAMPF, Raporun \u2018Sonu\u00e7 ve Talep\u2019 b\u00f6l\u00fcm\u00fcnde 4 hususun dikkate al\u0131nmas\u0131n\u0131 talep ediyor. Sundu\u011fu t\u00fcm bilgi ve de\u011ferlendirmelerin \u0131\u015f\u0131\u011f\u0131nda, ilgili AB mevzuat\u0131, rekabet hukuku uygulamalar\u0131 ve 12 Mart 2021 tarihinde a\u00e7\u0131klanan Reform Program\u0131nda yer verilen konuya ili\u015fkin hedefler \u00e7er\u00e7evesinde T\u00fcrkiye\u2019de dijital pazaryerlerine y\u00f6nelik kamusal d\u00fczenlemelerin haz\u0131rlanmas\u0131nda talep edilen hususlar \u015f\u00f6yle:<br \/>\u2022 Dijital pazaryeri hizmet sunucular\u0131 ile \u00e7o\u011fu KOB\u0130 s\u0131fat\u0131n\u0131 ta\u015f\u0131yan ticari kullan\u0131c\u0131lar\u0131n, \u00f6ng\u00f6r\u00fclebilir bir ortamda, adil ko\u015fullar alt\u0131nda ticari ili\u015fki kurabilmelerini teminen, AB\u2019de y\u00fcr\u00fcrl\u00fckte olan, \u201cOnline Arac\u0131l\u0131k Hizmetlerini Ticari Ama\u00e7l\u0131 Kullananlar i\u00e7in \u015eeffafl\u0131k ve Tarafs\u0131zl\u0131\u011f\u0131n Geli\u015ftirilmesine Dair 2019\/1150 say\u0131l\u0131 T\u00fcz\u00fc\u011f\u00fc\u201d (P2B T\u00fcz\u00fc\u011f\u00fc) esas alan bir kanun \u00f6ncelikle ve ivedilikle haz\u0131rlanmal\u0131 ve bu kanuna y\u00fcr\u00fcrl\u00fck kazand\u0131r\u0131lmal\u0131d\u0131r.<\/p><p>\u2022 Dijital hizmet sunucular\u0131 aras\u0131nda rekabetin tesis edilmesi, b\u00f6ylece hem t\u00fcketiciler hem de ticari kullan\u0131c\u0131lar i\u00e7in alternatif mecra olanaklar\u0131 yaratmak \u00fczere Rekabetin Korunmas\u0131 Hakk\u0131nda Kanun\u2019da gerekli revizyonlar yap\u0131lmal\u0131d\u0131r.<\/p><p>\u2022 Mevcut durumda g\u00fcn\u00fcn ihtiya\u00e7lar\u0131n\u0131 kar\u015f\u0131layabilme kapasitesi tart\u0131\u015fmal\u0131 olan Elektronik Ticaret Kanunu ve buna dayan\u0131larak \u00e7\u0131kar\u0131lan ikincil mevzuat h\u00fck\u00fcmlerinde, AB Dijital Hizmetler Kanun Tasla\u011f\u0131nda yer alan h\u00fck\u00fcmler esas al\u0131narak de\u011fi\u015fikli\u011fe gidilmelidir.<\/p><p>\u2022 AB\u2019de yasala\u015fma s\u00fcrecinde olan Dijital Piyasalar Kanunu\u2019nu referans alan, t\u00fcm dijital hizmetleri kapsayan ve b\u00fcy\u00fck \u00f6l\u00e7ekli ba\u015fat dijital hizmet sunucular\u0131na daha ayr\u0131nt\u0131l\u0131 d\u00fczenlenmi\u015f y\u00fck\u00fcml\u00fcl\u00fckler getiren yeni bir kanun haz\u0131rlanmal\u0131d\u0131r.<\/p><p>Bu hususlar\u0131n yan\u0131 s\u0131ra \u201cTAMPF Dijital Arac\u0131l\u0131k Hizmetlerine \u0130li\u015fkin Kamusal D\u00fczenlemeler&#8221; Raporunda ek olarak TAMPF\u2019\u0131n \u00f6zellikle P2B T\u00fcz\u00fc\u011f\u00fc\u2019n\u00fcn muadili olarak \u00e7\u0131kar\u0131lmas\u0131 beklenen Kanun\u2019da yer almas\u0131 gerekti\u011fini d\u00fc\u015f\u00fcnd\u00fc\u011f\u00fc Dijital Hizmet Piyasalar\u0131n\u0131n D\u00fczenlenmesinde Dikkate Al\u0131nmas\u0131 Gereken \u0130lke ve Kurallar da yer al\u0131yor.<\/p><p><a href=\"http:\/\/tampf.org.tr\/#\/show\/raporlar\">\u201cTAMPF Dijital Arac\u0131l\u0131k Hizmetlerine \u0130li\u015fkin Kamusal D\u00fczenlemeler&#8221;
